2015年6月5日，美国德州的专利授权公司Red Anvil, LLC (下称Red Anvil)，向美国德州东区联邦地院提起19起专利侵权告诉，控告多家公司所制造销售的平板计算机产品，侵害Red Anvil所拥有的一件专利权利。被控侵权的19家公司包括宏基(所列被告为其美国分公司Acer America Corporation)、宏达电(所列被告为其美国分公司HTC America Inc.)、华硕(所列被告为ASUSTeK Computer Inc.及其美国分公司ASUS Computer International Inc.，下称ASUS)、微星科技(所列被告为其美国分公司MSI Computer Corp.)等。
涉诉专利为美国专利编号US 5,680,223，名称Method and system for labeling a document for storage, manipulation, and retrieval，于1997年10月21日授权，原始权利人为Xerox Corporation。涉诉专利申请日为1995年5月15日，是US 5,448,375专利在申请时的连续案(continuation)，而后者的申请日即涉诉专利的优先权日为1992年3月20日。因此，涉诉专利权利有效期已满，这或许是Red Anvil在本案中仅要求损害赔偿的原因。
以Red Anvil控告ASUS一案为例，Red Anvil在其诉状中指出，涉诉专利所描述的发明为一种方法(即权利项12之内容)，其使用一个卷标图像(label image)来指示一个储存在数据处理系统中的数据文件，而当用户选择前述卷标图像时就可以存取该数据文件。Red Anvil主张，ASUS所制造销售平板计算机产品，特别是ASUS Eee Pad TF101、TF201、TF300T、TF700T、TF701T(均为Transformer Pad系列平板计算机)等产品，其所具备的图像缩略图技术功能(situated image thumbnail technology)，直接侵害了该专利的权利要求。
